These Terms & Conditions (“Terms”) outline the rights, responsibilities, and expectations relating to the use of the Mighty Love Agency website, services, and all interactions or agreements between you (“the Client”) and Mighty Love Agency (“we”, “our”, “us”). By accessing our website or engaging our services, you agree to all terms outlined below. If you do not agree to these Terms, please discontinue use of our website and services.

1. DEFINITIONS
Client: Any individual or business making use of the Mighty Love Agency website or services. Services: Any creative, marketing, digital, strategic, development, or consulting work provided by Mighty Love Agency. Website: www.mightyloveagency.com and all associated pages and platforms. Content: All text, media, graphics, code, and materials displayed or delivered by Mighty Love Agency.

2. ACCEPTANCE OF TERMS
Using the Mighty Love Agency website or engaging in our services constitutes acceptance of these Terms. These Terms apply to: Website visitors Clients receiving services Individuals submitting testimonials, inquiries, or personal information Users interacting with our digital platforms

3. SERVICES OFFERED
Mighty Love Agency provides digital and creative services including, but not limited to: Brand strategy and identity development Content creation Social media management Digital advertising and campaign execution Web design and development Digital presence setup and optimization Marketing strategy and consulting Creative direction & production Service details, inclusions, and project timelines will be specified in a formal quotation or proposal.

4. QUOTATIONS, PAYMENTS & BILLING
4.1 Quotations & Project Scope All quotes provided by Mighty Love Agency remain valid for the period stated on the quote. Work begins only upon: Client approval of the quotation Payment of the required deposit (if applicable) Any request outside the approved scope will require a revised or new quotation.

4.2 Deposits
Deposits are non-refundable unless stated otherwise. Deposits secure project timelines and resource allocation.

4.3 Payments
Payment terms appear on the invoice. Late payments may incur penalties or suspension of services. Mighty Love Agency retains all work and intellectual property until full payment is received.

4.4 Additional Costs
Costs may apply for: Extra revisions Additional design concepts Rush jobs or urgent deadlines Third-party tools, plug-ins, fonts, hosting, or software Stock media or licensed resources Clients will be notified before any additional cost is charged.

5. REVISIONS POLICY
To ensure quality and efficiency: Each service package includes a set number of free revisions as stated in the quotation. Revisions must align with the agreed project scope. Additional revisions beyond the included amount will incur a revision fee. Major changes, reworks, or new directions are considered a new project and will be quoted separately.

6. CANCELLATION & REFUND POLICY
Due to the nature of creative and digital services: Deposits are non-refundable. If a project is cancelled by the Client, all completed work and hours spent up to the cancellation date must be paid for. Refunds will not be issued for work already completed. If Mighty Love Agency cannot continue the project due to unforeseen circumstances, proportional refunds may be considered.

7. PORTFOLIO & PUBLICITY RIGHTS
Unless a confidentiality agreement is signed before project commencement: Mighty Love Agency may display completed work in its portfolio, marketing materials, presentations, website, and social media. This right applies to all final deliverables, visual designs, website builds, campaigns, and branded content. Work will never be shared before the Client launches it publicly unless permission is given. This clause is mandatory and non-negotiable unless an NDA is signed.

8. TESTIMONIALS & CLIENT FEEDBACK
Providing testimonials or ratings is voluntary. By submitting a testimonial, the Client grants Mighty Love Agency permission to publish it across digital and print platforms. Testimonials may be edited for clarity, length, or grammar but will never have their sentiment changed.

9. CLIENT RESPONSIBILITIES
The Client agrees to: Provide clear, timely feedback and required materials Review and approve work within reasonable timeframes Supply accurate information, brand assets, and project details Ensure they have rights to any materials they submit (logos, images, content, etc.) Comply with all legal obligations relating to their business and content Mighty Love Agency is not responsible for delays caused by slow client approval or incomplete information.

10. THIRD-PARTY TOOLS & INTEGRATIONS
The Client acknowledges that: Certain services may require third-party software, platforms, plug-ins, hosting, or subscriptions. Mighty Love Agency is not responsible for: Outages Price changes Platform failures Content loss caused by external services The Client is responsible for maintaining their own third-party accounts unless otherwise agreed.

11. INTELLECTUAL PROPERTY RIGHTS
11.1 Mighty Love Agency Ownership
Until full payment is received: All creative work remains the property of Mighty Love Agency. Mighty Love Agency retains source files unless explicitly included in the quotation.

11.2 Client Ownership
Once the project is paid in full: Final approved deliverables become the property of the Client. Source files, if included in the scope, will be provided.

11.3 Restrictions
The Client may not: Resell Mighty Love Agency’s work without permission Reuse drafts, unused concepts, or early-stage designs Claim authorship of work created by Mighty Love Agency

12. PRIVACY POLICY & DATA COLLECTION
Mighty Love Agency collects personal information such as: Name Email address Phone number Company name Project details Browsing data Information is used for: Communication Project management Quoting and invoicing Website analytics Legal and administrative purposes Mighty Love Agency does not sell, rent, or distribute personal data to third parties, other than trusted service providers who assist in delivering services (e.g., hosting, email systems, payment processors). Data is stored securely and processed according to South African POPIA compliance standards. Clients have the right to: Request access to their data Request correction or deletion Withdraw consent for marketing communication

13. WEBSITE USE POLICY

Mighty Love Agency reserves the right to terminate services if: Payments are overdue The Client is abusive, uncooperative, or violates these Terms Illegal or unethical behavior is discovered The project becomes unfeasible due to Client actions All completed work up to the termination date will be invoiced.

16. CHANGES TO TERMS
Mighty Love Agency may update these Terms at any time. The latest version will always appear on the website. Continued use of the website signifies acceptance of updated Terms.

17. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be handled by courts with jurisdiction in South Africa.
